Terms of Service

Please read these Terms and Conditions (“Terms” or “Terms and Conditions”) carefully before using https://myfivestartour.com/ (the “Service”) operated by Five Star Private VIP Tours (“us,” “we,” “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in or on the Service, and Five Start Private VIP Tour’s content, belong to us. We reserve all of its rights in and on the Service. Nothing in the Terms grants you a right or license to use any trademark, design right, or copyright owned or controlled by us or any other third party except as expressly provided in the Terms.

Reservation

A call to our office or an online inquiry DOES NOT represent a reservation agreement. One of our VIP Concierges would like the opportunity to speak with you first; so you know exactly what our service includes and does not include. Following your discussion with one of our VIP Concierges a reservation agreement will then be emailed to you upon request. No reservation agreement exists until the complete reservation form is received.

Cancellation / No Show Policy

We require a $100.00 deposit per day you would like to reserve. In order to receive a full refund of your deposit, you must provide a 14 day material notice for cancellations from your date of service. Regardless of the reason, cancellations within 72 hours of the date of service or a “no show” will result in being charged the minimum 6 hours at the quoted rate for each day canceled or considered a “no show”.  We do not cancel for unfavorable weather as long as the attraction is open.  In the event the attraction is closed, you will not be charged for that day.

All Private VIP Experiences that require purchasing in full during Peak Seasons are non-refundable. Clients are sometimes asked to purchase an experience in full due to limited availability, high demands, extraordinary requests, planning, and/or possible loss of income for the company and individual contractors during the time period.  As with everything in life, there will be exceptions made on a case by case basis for emergency purposes, but the refund will not exceed 10% of the total. We are only after what is fair and appropriate for all involved.

Payment

Five Star Private VIP Tours will automatically charge your credit card on file for the invoice amount each day of your experience, unless otherwise indicated.  If you choose to use a different payment method to pay your invoice, it is the responsibility of the client to contact our office prior to update this information.  Failure to pay the invoice balance in full within 7 days from the last day of service will result in a 10% late fee.  Invoices not paid in full within 90 days of last day of service will be sent to collection.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Links and/or Recommendations

Our Service may contain links, and/or recommendations to third-party sites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party site or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, unsatisfactory service, any damage, loss caused, alleged to be caused by, in connection with use of, or reliance on any such content, goods or service available on or through any such site or service.

We strongly advise you to read the terms and conditions, privacy policies of any third-party sites, or services that you visit.

Start Times for our Experiences

All of our experiences require an early morning start. This is mandatory for all of our experiences. The start times vary depending on the time of year and which attraction is scheduled for that day. Typically, you should expect to start 45min prior to the attraction opening. This allows time for safe travel to the attraction, time to go through all security check points, and early arrival at the attraction.

Suggested Gratuity

We are often asked about gratuity. Our VIP Guides aka “Private Assistant” truly love what they do and truly care about your families vacation. They will spend endless amounts of time to ensure your family has an unforgettable experience. Therefore, a 20% gratuity is the suggested.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States of America without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
