Please read these Terms and Conditions (“Terms” or “Terms and Conditions”) carefully before using https://myfivestartour.com (the “Service”) operated by Five Star Orlando VIP Tours (“us,” “we,” “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Intellectual Property
All copyright, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered) in or on the Service, and Five Star Orlando VIP Tour’s content, belong to us. We reserve all of its rights in and on the Service. Nothing in the Terms grants you a right or license to use any trademark, design right, or copyright owned or controlled by us or any other third party except as expressly provided in the Terms.
Reservation
A call to our office, email, or an online inquiry DOES NOT represent a reservation agreement. We would like the opportunity to speak with you first; so you know exactly what our service includes and does not include. Following your discussion, a reservation agreement will then be emailed to you if requested. No reservation agreement exists until the reservation form is received and the deposit has been successfully processed. Seasonal rates may apply aka dynamic pricing. Therefore, a delay in the submission of your reservation form may result in a higher quote or possibly no availability. All quotes will be honored for 72 hours from the time you received the reservation form.
Deposit
We require a deposit for each day you would like to reserve. Your deposit will be deducted from your final day as long as you complete all days reserved. The deposit is non-refundable but will be placed as a credit with us in the event you need to cancel or reschedule.
Cancellation / No-Show Policy
Cancellations must be made (14) days prior to the date of service to avoid the Full Payment penalty. Regardless of the reason, cancellations within (14) days of the date of service or a “no show” will result in being charged the minimum hours for each day at the quoted rate for each day canceled or considered a “no show”. We do not cancel for unfavorable weather as long as the attraction is open. In the event the attraction is closed, you will not be charged for that day. All VIP services that require “Full Payment” upfront are non-refundable regardless of circumstances. Clients are sometimes asked to pay in Full at the time of booking due to limited availability, high demands, extraordinary requests, extensive planning, and possible loss of income for the company, third-party companies, and/or independent contractors during the time period. As with everything in life, there will be exceptions made on a case-by-case basis for an emergency, but the refund will not exceed 10% of the total. However, you will NEVER lose your Deposit or any Full Payments made to us. Though you will automatically be charged per our cancelation policy mentioned above, in the event you are not able to make the trip, or not feeling well, you will receive an indefinite credit for all monies paid which can be applied to a future date with us on a day by day basis. At no point can deposits be combined to pay for a single day or stacked towards other days. Future Dates are subject to availability and Rates and/or Deposits may be higher during the time you choose to reschedule. You will be required to pay the difference in the rate and/or deposit to reserve your new dates. We are only after what is fair and appropriate for all involved.
Payment
Five Star Orlando VIP Tours will automatically charge your credit card on file for the owed amount per this agreement. If you choose to use a different payment method to pay your balance, it is the responsibility of the client to contact our office to update this information prior to your arrival. Failure to pay the invoice balance in full within 7 days from the date of service will result in a 10% late fee. Invoices not paid in full within 90 days of the last day of service will be sent to collection.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Links and/or Recommendations
Our Service may contain links, and/or recommendations to third-party sites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for unsatisfactory service, any damage, loss caused, alleged to be caused by, in connection with the use of, or reliance on any such content, goods, or service available on or through any such site or service. We strongly advise you to read the terms and conditions, and privacy policies of any third-party sites, or services that you visit.
Early Morning Start Times
We require a mandatory early morning start. The start time depends on the time of year and which attraction is scheduled for that day. Typically, you should expect to start 45min prior to the attraction opening. This allows time for safe travel to the attraction, time to go through all security checkpoints, and early arrival at the attraction.
Dining Reservations
Dining reservations are not guaranteed as they are subject to availability. Due to the limited availability of dining reservations, we are only able to assist clients with dining reservations who reserve our services outside of the 60-day dining reservation window. If you reserve our services within the 60-day dining reservation window you are responsible for booking your own dining reservations, modifying reservations, and cancel reservations.
Gratuity?
We are often asked about gratuity. Our VIP Assistants aka “Guides” truly love what they do and truly care about your family’s vacation. They will spend endless amounts of time ensuring your family has an unforgettable experience. Therefore, a 15-20% gratuity is suggested.
Disclaimer
Five Star Orlando VIP Tours is NOT affiliated with The Walt Disney Company, NBCUniversal (Comcast), SeaWorld Entertainment, or Merlin Entertainments. Five Star Orlando VIP Tours is an Independent Concierge service that specializes in organizing Private VIP Tours.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States of America without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide notice prior to any new terms taking effect.
